Choosing the Correct Notarial Certificate
One of the most common questions clients ask is:
“Which notarial certificate do I need?”
The answer depends on the requirements of the document, the organization requesting the notarization, and the purpose for which the document will be used.
As a commissioned Virginia Notary Public, I cannot determine which notarial act or certificate is appropriate for your document. Doing so could constitute the unauthorized practice of law because selecting a certificate may require a legal determination regarding the document’s intended effect.
However, I can:

- Explain the general purpose of each type of notarial act.
- Perform the notarial act that you, your attorney, the document preparer, your lender, title company, government agency, or another authorized individual has identified as the appropriate certificate.
The final decision regarding which certificate should be used must come from you or another person legally authorized to make that determination.
If You Are Unsure Which Certificate You Need
If, after reviewing the available certificates, you are still uncertain which notarial act applies to your document, you should not guess.
Instead, we recommend contacting one of the following:
- The attorney who prepared your document
- The lender or title company handling your transaction
- The government agency requesting the document
- The organization that provided the document

If none of these resources can identify the appropriate certificate, you should seek competent legal advice before proceeding with your notarization.
Selecting the incorrect certificate may delay the acceptance of your document or require the notarization to be completed again.
